I know this is rapidly becoming a sore topic around here, so I'll get to the point...

-Daniel Robbins can NEVER contribute to the Gentoo project again for the rest of his life. Indeed, this was probably the point of hiring him. If he so much as answers a question in a forum one day, Microsoft can and will sue the entire project out of existence. I hope those responsible for managing code contributions in the Gentoo codebase know this.

-We had a period of time of 3 weeks between when Robbins accepted the Microsoft position and it became generally known, wherein he could have contributed something on which Microsoft could later make a claim. While I am sure he was aware of the IP implications of signing up with Microsoft, the problem is that the next high profile Linux developer who gets picked off might not be so saavy. I hope that Gentoo developers have a means in place of sanitizing incoming code contributions so that IP claims can't leak into the general distribution.

He hasn't been active in the gentoo project for a couple of months at least. He resigned his dev position in april I thought.

Basically there are no implications for gentoo.

Holy cow, people are taking this WAY too seriously. Would anyone care if Ian Murdoc (the founder of Debian) started working for Microsoft? No. Because it doesn't matter. Neither does this matter. Daniel Robbins does not work on Gentoo anymore.

Two points:

1. Daniel Robbins was not hired for his coding abilities. I don't think he has access to any Microsoft source code of note, and so there wouldn't be any possible legal implications if he decided to contribute again.

2. Why would Microsoft try to hinder development of an obscure GNU/Linux distribution that does not in any way compete with them? Microsoft is worried about distributions such as Novell Linux and RHEL, not hobbyist distributions such as Gentoo.
